Price escalation claim for contractors in Pakistan

Escalation (also called price adjustment) is the extra payment a contractor can receive when the cost of materials, labour or fuel rises after the bid. Whether you are entitled depends on your contract: some contracts include a price-adjustment formula based on published price indices, some allow adjustment for changes in law or taxes, and some are fixed-price with no escalation.

Common causes

Why it happens

Material price rise

Steel, cement, bitumen, fuel and other inputs rose sharply after the bid date.

Long or delayed project

The project ran longer than planned, so more work was done at higher prices.

Changes in law or taxes

New or changed taxes, duties or regulations increased your cost.

Formula not applied

The contract has a price-adjustment clause but it was not applied in your bills.

Wrong base indices

Base date or base indices used in the calculation are disputed.

Delay caused by the client

Work pushed into a higher-price period because of employer delay.

What you can do

Practical steps

  1. Find the price-adjustment, escalation and change-in-law provisions in your contract and its schedules.
  2. Check the base date and which indices or price sources the contract uses.
  3. Give notice and claim in the form and time the contract requires.
  4. Calculate the escalation bill by bill, with the indices for each period.
  5. If delay caused by the client pushed work into higher prices, link the escalation to your EOT or delay claim.
  6. If it is refused, use the dispute route in your contract.

FAQ

Frequently asked questions

  • Is escalation allowed on every contract?

No. It depends on the contract. Some include a price-adjustment formula, some cover only changes in law or taxes, and some are fixed-price.

  • Which price indices are used?

Whichever indices or sources your contract names. In many public contracts in Pakistan these are published official indices, but always check your own contract schedule.

  • Can I claim escalation for delay caused by the department?

Often the delay and its cost effects can be claimed together with an EOT claim, depending on your contract terms and notices.

  • Can you guarantee the claim will be approved?

No. We prepare a properly documented claim; the decision rests with the Engineer, client, adjudicator or arbitrator.
